ARZINGER's litigation team has once again successfully defended the interests of a group of solar power generation companies in a dispute against russia over damages. The damages were caused by the seizure of a solar power plant in the occupied territory of Zaporizhzhia region for more than UAH 1 billion. Thus, ARZINGER’s attorneys managed to prove the guilt of the aggressor state in causing damages due to the mere fact of occupation of the territories of Ukraine and loss of control over the power generation facility. This conceptually complements the practice of resolving similar cases.
In addition, the court granted the claim for damages in the form of lost profits for UAH 69 million.
The team working on the case included senior associate Ivan Zalizniak, former senior associate Iryna Hutnik, junior associate Yana Nesterenko, and managing associate Andrii Tyshchenko, led by founding partner Sergii Shkliar.
The above decision is the second in a series of disputes concerning the recovery of damages from the russian federation related to the energy production sector. In another case, UAH 1.1 billion in damages were recovered similarly: https://lnkd.in/eu7GsMxV
