Main Areas of Practice:

Labor & Employment: 100%

Representing corporate entities since Brazil’s labor code was first drafted, the team — approximately 30 attorneys — covers all labor related matters and draws on the extensive experience of both advisory work and litigation. Advisory services include consulting, auditing, compliance with employment contracts, and following up on government inspections and administrative proceedings. The litigation practice covers every state in Brazil and acts in labour courts or tribunals at all levels.

Labor Legal Consulting:

  • Full legal support for the analysis and presentation of hypotheses, risks and solutions for any labor and union issues related to Labor Law (individual, collective, union and procedural law).

Labor Compliance:

  • The firm provides legal support in the development and review of labor compliance programs, with a focus on the establishment and verification of compliance of the practices of the company’s labor relations with the legislation (laws and labor regulatory standards). Our work is focused on the development of: participation in working groups for the creation and implementation of compliance programs; legal advice on labor to compliance committees or to the CCO (Chief Compliance Officer); formulation and review of codes and corporate policies, internal rules and with views to corporate integrity; identification and mapping of risks and consulting to conduct internal investigations and application of disciplinary sanctions.

Labor Administrative Litigation:

  • The law office is predominant in the administrative litigation arena, in extrajudicial processes and procedures initiated by the Labor Prosecution Office (civil investigations, consent decrees, etc.) and by the Ministry of Labor (violation notices and debt assessments arising from labor inspections). Highly strategic and sensitive, these procedures are intended to investigate allegations of non-compliance with labor laws at a collective level, where the Labor Prosecution Office looks for elements to substantiate a possible Public-Interest Civil Action (class action), with a potential risk for financial losses (fines and indemnities) and damage to the company's image.

Labor Litigation & Risk Analysis:

  • Financial contingency in proceedings carried out with a high level of sensitivity and attention
  • Provisions
  • Establish a contingency amount for the proceedings, which is reviewed in the sentence and in each new judgment in higher instances

Labor Judicial Litigation:
In the realm of judicial litigations, the firm is distinguished for both individual claims involving cases arising from personal labor relations and collective proceedings involving disputes with the Labor Prosecution Office (MPT), Trade Unions representing professional groups and the Federal Government (federal labor monitoring).

Labor Negotiation and Arbitration:

  • Conflict mediation

  • Legal consulting for union collective act providing support in mergers and acquisitions processes, installation of new sites and plants, changes in preponderant activities with the consequent change of union classification, etc.
  • Direct and leading role in union collective agreements
