Leijnse Artz’s comprehensive industry-focused team of lawyers have been advising clients in the healthcare and life sciences industry sectors for many years on a broad spectrum of matters, both contentious and non-contentious. Its lawyers are closely involved in policy initiatives and have excellent contacts with regulators and competent authorities, self-regulatory bodies and trade associations. This means that the team is well-placed to provide highly strategic advice on complex matters. The multidisciplinary practice covers civil, regulatory and criminal matters relating to healthcare, pharmaceuticals, medical devices, biotech, food, cosmetics and biocides. The team has a particular focus on EU and Dutch regulatory law (i.a. clinical trials, market authorisations, product certification/ notification, pricing and reimbursement, advertising, borderline products, product safety, manufacturing and distribution), and the team also advises on related matters, including competition law, product and medical liability, privacy, trademarks and parallel import. Furthermore the team provides assistance in regulatory and enforcement investigations by the authorities (IGJ, NVWA, NZa, ACM, AP). Clients span all industry sectors, and range from leading multinational companies and trade associations, to pharmacies, hospitals and individual healthcare professionals.

Advertising & Unfair Competition:

Specialised legal expertise and skills are necessary in order to protect intellectual property optimally and cash in on realised innovations, to successfully act against unfair competition (such as misleading advertising, the use of someone else’s knowhow and slavish imitation) and to overcome obstacles in existing and new markets. Leijnse Artz can offer this and assists clients with all the required legal support, such as legal opinions, assisting with negotiations, drafting (collaboration) agreements and conducting litigation (also for preliminary relief). Our clients in this area are mainly innovative market leaders and companies realising a strong growth by anticipating new rules and/or social developments. Leijnse Artz has extensive experience representing clients in legal proceedings before the Dutch courts as well as in procedures before self-regulatory bodies, such as the advertising code committee (RCC) and the Code Committee of the Foundation for the Code for Pharmaceutical Advertising (CGR).
