-Representation of HDI Seguros S.A. was structured in (i) denying the existence of an employment relationship between the deceased and Fundiciones Universo S.A., (ii) the absence of fault of the employer in the occurrence of the damage and the causal link between the fault and the damage caused because the incident occurred due to the exclusive fault of the victim and (iii) the absence of the assumptions established in article 216 of the CST. During the evidentiary process, testimonies were examined and documentary evidence was provided to demonstrate that the deceased was not an employee of the company that contracted the civil liability policy.
