Case Results

3M’s Combat Arms version 2 (“CAEv2”) earplugs MDL: Mike Sacchet and Megan Odom part of bellwether trial teams that obtained verdicts in favor of their clients for $110 million, $8.2 million, $7.1 million, and $1.7 million.

Plaintiff’s Auto Accident Case: Kathleen Flynn Peterson and Robert J. King, Jr. obtained a $13.14 million verdict on behalf of their client, a 44-year-old man who suffered a traumatic brain injury when his pickup truck was hit by a truck from a local turkey farm that failed to yield the right of way.

Claimant vs. Hospital and Providers: Michael Ciresi and Mat Korte pursued and negotiated a $25 million settlement on behalf of a husband and father for catastrophic injuries and permanent impairment as a result of the failure to chart medication exposure in the patient’s record.

Kraft Foods Group, Inc./Mondelēz International, Inc. v. Starbucks Coffee Company: Michael Ciresi, Katie Crosby Lehmann, Mat Korte, and Melissa Goodman represented Kraft in a three-year arbitration regarding a breach of contract after Starbucks unilaterally terminated its agreement, cutting off Kraft’s exclusive rights to sell, market and distribute Starbucks roast and ground coffee in grocery and other retail outlets. The arbitration resulted in a $2.7 billion cash award to Kraft.

State of Alaska v. Williams Alaska Petroleum Inc., et al.: Jan Conlin and Mat Korte were trial counsel against former refinery operator concerning statutory and contractual liability related to groundwater contamination in the City of North Pole, Alaska. Multi-week trial resulted in judgment in favor of client and the State of Alaska, and a finding the refinery operator liable to pay for over $80 million in past damages plus other costs and liabilities.

Negotiated Settlement of $27 million: Jan Conlin, Heather McElroy, Barry Landy, and Kyle Wislocky negotiated settlement in a royalty fee dispute which was scheduled for arbitration.

Carver v. The Bank New York Mellon (S.D.N.Y.): Michael Ciresi, Jan Conlin, Heather McElroy, and Barry Landy obtained a $12.5 million settlement as Co-Lead Class Counsel for ERISA Plaintiffs.

Northeastern Minnesotans for Wilderness v. Minnesota DNR: Katie Crosby Lehmann, Heather McElroy, and Melissa Goodman are co-lead counsel in a Minnesota Environmental Rights Act case against Minnesota DNR alleging that DNR’s existing rules and regulations will fail to protect the water, land, and air from material harm caused by copper mining on the edge of the Boundary Water Canoe Area.

Kathleen Flynn Peterson settled a claim for $18 million for a woman who suffered loss of significant portions of all four limbs.

Brandon Thompson obtained a $9.1 million verdict for a 51-year-old man who was paralyzed from the waist down following surgery for a perforated bowel.

Colin Peterson obtained a $13.5 million settlement in a medical malpractice case that involved an injury to a patient’s upper extremities related to the use of restraints in a Minnesota hospital.
