Rodríguez Dávalos Abogados was the leading counsel of the three phases of 'Los Ramones' pipeline which is Mexico’s most ambitious natural gas pipeline project. This project, considered of strategic importance for Mexico, stretches from the United States of America’s border to the state of Guanajuato, Mexico.
As a result of Mexico’s Energy Reform, all of the country’s storage and transportation infrastructure for petrochemicals and refined products transitioned from a regime solely handled by Pemex, to an open access model, allowing, also, the participation of the private sector in such activities. Within this new regulatory context, Rodríguez Dávalos Abogados has provided the advice needed to obtain regulatory permits and rates for 77 refined products and petrochemical storage facilities as well as eight pipeline systems for the transportation of crude oil, refined products and petrochemicals.
To achieve these outstanding results, its multidisciplinary team of lawyers, economists, engineers, actuaries and mathematicians - provide clients with unique and wide-ranged perspective going beyond the legal realm. Its business and economic advisory services provide far-reaching results dealing with commercial factors for the optimal development of the projects such as regulated rate cases, business plan development, anti-trust advisory and market and demand analysis, among many other services. Rodríguez Dávalos Abogados has an impressive track record, leading highly strategic energy projects in Mexico. Its legal and commercial consulting services have achieved extraordinary results for their clients. As advisors of the developers, Rodríguez Dávalos Abogados guides and accompanies clients closely throughout the process, from the idea or very first stage through the development, execution, and full operation of the project.
From the design of the business strategy to the concrete fulfillment of it, the firm covers the full scope of legal, commercial, and economic matters relevant for the development of a project. Rodríguez Dávalos Abogados offers a unique and comprehensive approach on negotiation of material contracts, such as JOAs, JBAs, O&Ms, EPCs, TSAs, SSAs, OBAs, natural gas purchase agreements, LPG purchase agreements, refined products purchase agreements, interconnection agreements, credit agreements and PPAs, among many others.
RDA has an unparalleled mastery of regulatory issues, providing: legal advice, filing, monitoring and management of the required permits before different governmental agencies such as the Energy Regulatory Commission (CRE), Energy Ministry (SENER), National Hydrocarbons Commission (CNH), Antitrust Commission (COFECE) on the local, state and federal levels, The Energy Safety and Environmental Agency (ASEA) and Water authorities, as well as the International Boundary and Water Commission (CILA) for cross-border permits, among others. RDA has a solid experience with environmental permits (e.g. MIA), social impact reports, risk assessment studies, etjs, to name some of the firm’s services.
In great measure, the success of an energy project involves land acquisition and Right of Way expertise. RDA is a true specialist in this extremely important aspect.
The firm handles the different stages including: the negotiation, acquisition of land and the legal defence of rights of way. An example of this complexity was the aforementioned 1000 km 'Los Ramones' pipeline system that stretches from the United States of America border to the central part of Mexico.
Rodríguez Dávalos Abogados has represented foreign and domestic energy companies, Mexican state-owned productive companies as well as energy-related government agencies. The firm has strong presence in the entire value chain of the energy sector; including: upstream, midstream and downstream segments of the oil and gas industry; as well as in power generation, renewable energies, transmission and marketing of electricity. RDA also works with clients engaged in maritime activities related to the energy industry.
Members of RDA have actively participated providing advisory services in the lawmaking processes and applicable regulations to the energy sector, such as:
■ The Energy Regulatory Commission Law
■ Natural Gas Regulations
■ Liquefied Petroleum Gas Regulations
■ Applicable guidelines or directives to natural gas and liquefied petroleum gas
Rodríguez Dávalos Abogados has a broad knowledge regarding the official standards applicable to natural gas and LPG (implementation and enforcement aspects) and has successfully advised several industry associations on regulatory matters.
A substantial part of RDA’s client portfolio are large international companies as well as Mexican organisations conducting business abroad; these clients have engaged RDA in projects in the US and in Central America. Among them, RDA has done substantive work on imports and exports of hydrocarbons to and from the United States of America and Central America. Rodríguez Dávalos Abogados has been involved in the development of a natural gas combined cycle plant in Northwest Mexico to sell power to CFE and private consumers. Said plant has direct access to a natural gas pipeline originating in the United States of America and high voltage power lines (115 kV) from CFE.
Other projects that the firm has recently worked on are: the gas pipeline to import natural gas to CFE’s plants at Puerto Libertad, Guaymas and Topolobampo (from Tucson, Arizona to Sonora, Mexico); the natural gas pipeline from the Nueces County, Texas to the United States of America borderline near Rio Grande, Texas; Los Ramones phase I and the natural gas pipeline from the United States of America’s border to the Compression Station of 'Los Ramones' in the state of Nuevo León, Mexico (the pipeline receives natural gas from the Agua-Dulce Pipeline in the United States of America); the negotiation of a $240,000,000 million USD natural gas supply agreement.
RDA worked successfully on a power exportation project that consists on the import of natural gas from the United States of America to supply a power generation plant, with a 143MW capacity, located in the northern state of Nuevo León, Mexico, whose purpose is the export of power to Guatemala. The afore-mentioned project is considered one of the most innovative and complex projects of power exportation in Mexico.
Rodríguez Dávalos Abogados has represented both Mexican State-owned productive companies (e.g. PEMEX and CFE). It has also represented domestic and foreign energy-related companies, including large international upstream, midstream, and downstream publicly traded companies. RDA has, as well, advised several industry associations on regulatory matters.
