In 2018, one of Orchard’s projects was recognised by Kommersant in a special category called “Formation of Case Law in the Retail Industry”. As part of the project, Orchards represented Agrotorg LLC (an X5 Retail Group company) in a dispute against the Russian antitrust authority which resulted in the Russian Supreme Court’s Judicial Chamber on Economic Disputes adopting an all-encompassing approach to business protection which disallowed a broad interpretation of Article 14 of the Trade Law limiting retail chains whose market share exceeds 25% in acquiring or leasing new retail premises.
Earlier, in 2017, the firm was recognised by Kommersant for the successful completion of two projects which made it to the publication’s Top-10 most notable disputes of the year: in the first one, the firm protected interests of SL Gold LLC (a joint venture of Polyus Gold and Rostec Corporation) in a dispute challenging the results of an auction to award the right to develop Sukhoi Log, one of Russia’s major gold deposits; and in the second one, the firm assisted Partner LLC in judicial recovery of over RUB 3 billion in damages.
In 2016, the team successfully represented Tizpribor PJSC in the appellate and cassation courts in a dispute with VimpelCom seeking to amend the terms and conditions of a lease agreement by setting up an exchange rate “band” instead of a fixed rent rate denominated in USD. In just a few months, the dispute topped the list of high-profile private disputes in 2016. It was discussed extensively within the legal and business communities, including various conferences and business roundtables.
