Connecticut Retirement Plans and Trust Fund.

  • In re American International Group Securities Litigation – more than $1 billion total recovery and one of the top 15 securities class action recoveries
  • In re Schering-Plough/Enhance Securities Litigation – secured a $473 million settlement for investors and was praised for the “herculean efforts of Plaintiffs’ Counsel”
  • In re SCANA Corporation Securities Litigation– recovered $192.5 million, the largest securities fraud settlement in the history of the District of South Carolina
  • In re Nielsen Holdings PLC Securities Litigation – secured a $73 million settlement in a high profile suit against the data analytics company


Corporate Governance & Shareholder Rights Litigation:

Labaton Keller Sucharow’s work on behalf of institutional investors has made the Firm a leading advocate in the Court of Chancery. As corporate leaders continue to engage in fraudulent conduct and other mechanisms to unjustly enrich themselves, the Firm has initiated numerous derivative and M&A-related suits and secured major victories on behalf of shareholders. This includes a landmark victory in the Delaware Supreme Court in In re Earthstone Energy, Inc. that will have a lasting impact on Delaware courts.

  • In re Dell Technologies Inc. Class V. Stockholders Litigation – historic $1 billion settlement and the largest recovery prior to judgment ever achieved in a fiduciary duty action in the Delaware Court of Chancery.
  • In re Freeport-McMoRan Copper & Gold Inc. Derivative Litigation – obtained a $153.75 million settlement, the second largest derivative settlement in the Court of Chancery history, which included an unprecedented settlement term for shareholders
  • In re Coty Inc. Stockholder Litigation, Consol. – achieved a $35 million settlement weeks before trial in a class and derivative lawsuit against Coty’s board of directors and its controlling shareholder JAB alleging conflicts and unfair terms in a $1.7 billion deal
  • City of Warwick Retirement System v. Snap, Inc. et al. – represents owners of Snap Inc. Class A Common stock in an action to remedy Snap Inc.’s violation of Section 242 of the Delaware General Corporation Law and for breaches of fiduciary duty by Snap’s controlling stockholders and board of directors

The team achieved a historic $650m settlement in the In re Facebook Biometric Information Privacy Litigation matter—the largest consumer data privacy settlement ever, and one of the first cases asserting biometric privacy rights of consumers under Illinois’ Biometric Information Privacy Act (BIPA).

  • Garner et al. v. Amazon.com Inc., et al. – a consumer class action against Amazon, Inc. and Amazon.com Services LLC (collectively, Amazon) on behalf of all persons, including adults, whose conversations and voices were illegally wiretapped, recorded, and intercepted by devices operating Amazon’s Alexa technology. The case alleges that such recordings, made without such persons’ knowledge or consent, violate federal and state wiretapping laws, including the California Invasion of Privacy Act.
  • Frasco v. Flo Health Inc, No. 3:21-cv-00757-JD (N.D. Cal.) – a data privacy litigation against fertility app maker Flo Health Inc, Facebook, Google, Flurry, and AppsFlyer. Flo Health is accused of sharing private medical consumer information with Facebook, Google, and others, without the knowledge or consent of its users.


International Work: Non-US Securities Litigation:

The firm’s non-US securities litigation practice is dedicated to working with non-US counsel to analyze potential claims in all international jurisdictions in which it is possible to seek a recovery. The firm’s attorneys have decades of experience advising institutional investors on the risks and benefits of pursuing claims in non-US forums.
