Firm Overview:
Founded in 1984 by Ernesto Tzirulnik, Ernesto Tzirulnik Advocacia (ETAD) is highly specialised in insurance and reinsurance law and related matters. ETAD’s outstanding performance is closely related to a careful process of work acceptance, based on the highest legal and technical standards, as well as the strong values that drive the firm. ETAD’s services include civil and administrative litigation, advice on the drafting of contracts, tailor-made insurance policies, strategy recommendations, full support during lost adjustment procedures, as well as litigation and arbitration.

ETAD and its partners support and act cooperating with IBDS – Brazilian Institute of Insurance Law. Ernesto Tzirulnik is the president of IBDS and coordinated the commission of jurists in connection with all bill of laws under debate before Brazilian parliament regarding the first Brazilian insurance contract law. Bill of law n. PL 3555/2004 was approved by House of Representatives in December 2016 (currently being debated in the senate under number PLC 29/2017).

ETAD promotes culture through Ceará 202 Project. Among other activities, the project is responsible for the restoration of the house at number 202 on Ceará street as the law firm’s headquarters. Known as the residence of architect Jayme C. Fonseca Rodrigues, it has recently been included in Iconic Houses, an international network connecting houses from the 20th century that are significant for architecture and open to the public as museums.

Besides architecture and other forms of artistic expression (films, photography and fine arts, among others), Ceará 202 Project promotes Brazilian music with the recording of CDs and the organisation of concerts open to the public at the porch of the law firm’s headquarters.

Main Areas of Practice:

Insurance & Reinsurance:
Corporate: 30%

ETAD has participated in almost all relevant insurance, reinsurance and civil liability cases in Brazil, including, among several others, representing the insured’s interest in the largest indemnification ever paid regarding an inland accident in Brazil (over US$500m), and the restructure of a life insurance policy in Brazil from legal and actuarial perspectives, bringing back to balance more than 800,000 insurance contracts. ETAD represented Companhia Siderúrgica Nacional (CSN) versus IRB-Brasil Re in the first lawsuit of its kind in Brazil, which succeeded in compelling IRB to participate in the renewal of CSN’s all risks insurance policy. ETAD nowadays is involved in practically all relevant cases involving infrastructure, business interruption, engineering and operational risks, performance, liability and D&O.

In addition to its work in insurance law, ETAD also represents its clients in important corporate law issues.

International Work:
ETAD has also been involved in the largest insurance claims in other Latin American countries, such as Argentina, Bolivia, Ecuador, Dominican Republic, Paraguay, Peru and Venezuela, as well as critical situations in which the insurance contract becomes a pinpoint issue between contractors and local governments, due to the magnitude of the interests involved.
