However, the firm has significant experience in the following areas of practice:
Advising UHNW individuals in respect of the build of some of the most ground-breaking superyachts to date. The value of these projects has ranged from in excess of €200m through to smaller projects. The firm’s work covers the fields of project management, banking/finance, dispute resolution, insurance and tax.
Yacht Sale & Purchase:
Bargate Murray is involved in a steady stream of S&P work and regularly advises both buyers and sellers of superyachts, predominantly on the well known Mediterranean Yacht Brokers Association sales form. The firm handles deals of all shapes and sizes from smaller sport yachts, tenders and support vessels through to yachts exceeding 100 metres in length.
Bargate Murray advised a number of clients on the implications of the Maritime Labour Convention which came into effect in 2013. These clients included the owner of the first Cayman Islands flagged yacht to pass its MLC audit and receive an MLC ‘letter of compliance’ from this prestigious registry. The firm is adept at handling a whole range of regulatory issues.
The yacht finance practice has seen Bargate Murray advise on several new financings, including collateralised loan agreements involving large yachts and a private jets. The combined value of the last two deals handled by the firm was approximately €130m.
With regard to tax, Bargate Murray (working where necessary with colleagues) provide cutting edge advice in the field of EU customs and VAT regulation. The firm regularly advises on the importation and use of yachts (and other luxury assets) within the EU and other areas of the world.
Bargate Murray advise of a wide range of aviation matters, including sale and purchase, finance and operations — the firm has recently advised the owner of a large private jet in respect of a finance transaction worth a total of approximately USD$90m.
The firm’s dispute resolution practice is comprehensive and covers litigation and arbitration with a focus on maritime arbitration both under LMAA terms and ad hoc references. The firm has particular expertise in yacht building disputes having advised the buyer of a large yacht in a long running construction dispute worth approximately €40m. The firm’s founder and CEO, Quentin Bargate, is regularly appointed as an Arbitrator in maritime disputes under LMAA terms.
Bargate Murray also provide general commercial advice to businesses. The team work with clients including large and small tech companies, foreign government bodies and companies operating in the ultra luxury travel space.
