How to Drive the Value of Antitrust Claims Through Litigation Finance

Antitrust lawsuits are distinctive in their complexity, duration, cost, and potential damages. They also require expensive specialized counsel and expert testimony. This is true not only for class actions and multidistrict litigation, but also for single-plaintiff cases involving restraint of trade, price-fixing, monopolization, unfair competition, and other related claims. These singular attributes of antitrust cases make them an excellent fit for litigation finance arrangements with corporate plaintiffs either as opt-outs from class actions or as sole claimants.  In addition:

  • Financing can help strengthen claims, such as by facilitating more third-party discovery, hiring the best counsel and expert witnesses, and enabling corporate opt-out claims rather than costs compelling possible sub-optimal participation in a class.
     
  • Similarly, financing can help drive settlement value by enabling companies to resist early settlement pressure due to litigation costs, and by increasing defendants’ incentive to settle if the financing is disclosed.
     
  • Working with the right funder can also provide added value from experienced counsel at the funder who will evaluate and critique the case and provide insights as the litigation proceeds.

Jason Levine is an Investment Manager and Legal Counsel at Omni Bridgeway. In addition to leveraging his commercial litigation experience, Jason is responsible for leading the company’s antitrust litigation initiative and he heads the Washington D.C. office. A former litigation partner at Alston & Bird LLP and Vinson & Elkins LLP, Jason was also head of the Washington D.C. Trial practice group at McDermott Will & Emery LLP. Jason’s practice focused on commercial and contract litigation and the defense of nationwide antitrust class actions. He tried 14 cases in state and federal courts nationwide and before international arbitral venues. In total, Jason won over $3 billion in relief for plaintiff clients and avoided over $17 billion in potential liability for defendant clients. Jason uses his extensive first-chair experience to serve as a strategic partner, providing consultation on cases from beginning to end.

Bonnie Lau, Partner, Morrison & Foerster LLP

Bonnie helps clients navigate internal and government antitrust investigations, enforcement proceedings, and class action litigation in federal and state courts. She leverages her over 15 years of experience in civil and criminal antitrust litigation and investigations to advise clients across a range of industries that face government scrutiny, including technology, manufacturing, media, telecommunications, healthcare, and financial services. A dynamic litigator and trial lawyer, Bonnie has significant experience defending class actions, multidistrict litigations, and enforcement actions, and deftly handles international competition investigations and enforcement issues. She has tried several bench and jury trials to verdict, and recently served as lead trial counsel in an antitrust class action jury trial. She has defended companies in antitrust and related complex litigation involving claims of price-fixing, output suppression, monopolization, predatory pricing, and group boycott, as well as prosecuted antitrust counterclaims in patent and IP infringement matters. In addition to her work in the antitrust area, Bonnie has represented clients in various complex commercial litigation and alternative dispute resolution matters relating to unfair competition, RICO, TCPA, and intellectual property claims.

David Kesselman, Partner, Kesselman Brantly Stockinger LLP

David W. Kesselman is a Partner of Kesselman, Brantly & Stockinger LLP. Prior to founding KBS, Mr. Kesselman was a partner in the highly regarded antitrust and litigation boutique, Blecher & Collins, P.C., in Los Angeles. He began his legal career at the international law firm, Jones Day. Mr. Kesselman has represented plaintiffs and defendants in complex litigation matters including: antitrust, unfair competition, business tort, copyright, class action, and employment cases. Mr. Kesselman has significant trial experience and has argued cases in both federal and state appellate courts. He has also provided antitrust counseling and compliance advice to corporations. For many years, Mr. Kesselman has served as an adjunct professor of antitrust law at Loyola Law School. Priyanka Timblo is an Associate Investment Manager and Legal Counsel at Omni Bridgeway. She conducts due diligence on potential investments and provides legal advice on matters of US law and antitrust matters. Prior to joining Omni Bridgeway, Priyanka was a litigator at Holwell Shuster & Goldberg LLP and Paul, Weiss, Rifkind, Wharton & Garrison LLP in New York.
