About

Provided by Miller Thomson LLP

Our National Aboriginal Group provides strategic business and legal advice to proponents on how to manage and address aboriginal and treaty rights in project development across Canada. The practice of aboriginal law continues to evolve and with Canada’s recent endorsement of The Declaration on the Rights of Indigenous Peoples (UNDRIP), the legal landscape is shifting dramatically. Consultation and accommodation of aboriginal rights continues to rank as one of the greatest risks in the regulatory process.

With a focus on facilitating project development, our Group’s members have advised on the nature of rights and interests, have developed defensible consultation plans, worked with clients through environmental assessments, permitting and regulatory approvals, and have successfully negotiated numerous commercial agreements and joint venture arrangements to facilitate aboriginal support.

In addition to project related matters, our team has extensive experience working with First Nations on land management and governance matters such as comprehensive land claims,  treaty land entitlement claims, resolution of past grievances, reserve land development, First Nations Land Management and the establishment of good governance.
