What the team is known for

Substantial Perth-headquartered practice particularly skilled in handling insurance matters involving the mining and natural resources industries. Combines a strong Western Australian offering with a national capability, augmented by the 2019 opening of a Sydney office. Primarily caters to insurer clients, both domestic and international, with a focus on contentious work. Notably active on professional indemnity claims but equally adept at handling claims relating to D&O liability, employers' indemnity, business interruption, and construction and project insurance claims. Other areas of advice include public and product liability, statutory inquiries and legislative compliance.

Strengths

One client reports that "Jackson McDonald are excellent at what they do in terms of their expertise, efficiency and client care," and also observes: "We tend to utilise them on bigger matters, where there are voluminous files, as they have the resources and capability to handle these with ease."

Another client states: "I have utilised their skills and expertise for some years, find their services outstanding and will continue to engage them whenever possible."

Work highlights

Acted successfully for IAG subsidiary CGU Workers' Compensation with regard to a compensation claim for PTSD allegedly sustained by a nurse during the course of a night shift, a matter made more complex by the fact that ownership of the business concerned changed during the same shift. The claim was dismissed in both litigated and arbitrated proceedings.

Notable practitioners

Sydney-based Stefan Sudweeks is an experienced litigator of professional indemnity and D&O liability cases on behalf of both domestic insurance and reinsurance companies and a number of Lloyd's syndicates. An interviewee who describes him as a "highly intelligent, very experienced and very sophisticated practitioner who thinks both analytically and strategically," adds: "His clients are lucky to have got him."
