Yoon & Yang LLC announced that it has welcomed Jongkwan (Josh) Peck as a Senior Foreign Attorney, strengthening its capabilities in nuclear power, small modular reactors (SMR), cross-border engineering, procurement and construction (EPC), and plant export contracts.
Mr. Peck brings more than 35 years of experience in energy and EPC-related projects, foreign investment, mergers and acquisitions, international litigation and arbitration. In particular, he has built extensive experience through advising on and negotiating key contracts for overseas nuclear power export projects undertaken by Korean companies.
Mr. Peck received a B.S. in Management from Boston College and a J.D. from Georgetown University Law Center. He is admitted to practice in New York and has practiced in Korea since 1990. He worked at Lee & Ko from 2001 until joining Yoon & Yang. Throughout his career, he has advised leading Korean and international companies on overseas nuclear power export projects, the Korean business development activities of global SMR companies, cross-border M&A and joint ventures, and international arbitration and litigation.
Mr. Peck played a key role in the Barakah Nuclear Power Plant project in the United Arab Emirates, the Republic of Korea’s first nuclear power export project. Representing Korea Electric Power Corporation (KEPCO), he handled the overall bidding and contracting process, including negotiations with the project owner, the Emirates Nuclear Energy Corporation (ENEC), for the Prime Contract. He subsequently participated in negotiations for follow-on agreements relating to the Barakah project, including Korea Hydro & Nuclear Power’s Operating Support Services Agreement (OSSA) and KEPCO KPS’ Long-Term Maintenance Agreement (LTMA). Through this work, he developed extensive advisory experience spanning the full lifecycle of a major overseas nuclear power project.
Mr. Peck has also advised KEPCO and Korea Hydro & Nuclear Power on a number of overseas nuclear power projects, including the Olkiluoto 4 (OL4) project in Finland, the El Dabaa Nuclear Power Plant project in Egypt, and nuclear power projects in Saudi Arabia. More recently, in connection with the Dukovany Nuclear Power Plant project in the Czech Republic, Mr. Peck led negotiations on the EPC Prime Contract on behalf of Korea Hydro & Nuclear Power with Elektrárna Dukovany II (EDU II), a subsidiary of ČEZ and the project owner. Following execution of the contract, he has continued to advise on a range of legal issues arising during project implementation.
Mr. Peck also brings substantial experience in international dispute resolution. He represented KEPCO and Korea Hydro & Nuclear Power in intellectual property and U.S. export control disputes involving Westinghouse in connection with overseas nuclear power bids, including proceedings before the Korean Commercial Arbitration Board (KCAB) and U.S. federal courts. Working in collaboration with international counsel, he has also advised on U.S. export control law and related response strategies.
Mr. Peck has developed significant experience in SMR projects, a next-generation nuclear power technology, by advising global SMR developers on their Korean business development activities. His experience extends across the nuclear power sector, from large-scale nuclear power projects to next-generation reactor technologies.
In addition to his energy-sector work, Mr. Peck has advised on a broad range of cross-border transactions. His experience includes advising on LG Chem’s acquisition of U.S.-based NanoH2O and the LG Group’s acquisition of U.S.-based Rolls-Royce Fuel Cell Systems, as well as foreign investment and joint venture transactions in Korea. He has also represented Korean and international companies, including Samsung C&T, LS Cable & System and Sikorsky, in International Chamber of Commerce (ICC) arbitrations and other international disputes.
In recognition of his expertise, Mr. Peck was named a Recommended Lawyer in the energy sector in the 2026 edition of Lexology Index, a global legal rankings institution.
With Mr. Peck’s arrival, Yoon & Yang will further enhance its overseas project advisory capabilities in the nuclear power, SMR and energy plant sectors. The firm will provide integrated legal services across the lifecycle of overseas nuclear power and SMR projects, from bidding processes and EPC contract negotiations through project implementation and international dispute resolution. The firm will also expand synergies with its cross-border M&A, joint venture and foreign investment practices.
