Unifrutti. Intenational trademark infringement and counterfeiting.

1.      Deal Description

Guerrero Olivos represented one of the most relevant local fresh fruit grower and exporter company, Unifrutti, on trademark infringement and counterfeiting matters in various Asian countries. A Chinese company was exporting counterfeit lemons to several Asian and African countries, using high quality Unifrutti labelled boxes. 

We contacted CCPIT-Patent and Trademark Law Office, and together we designed and executed a strategy. We filed a seizure request before the Chinese Shekou’s customs office, which was able to retain the 2 containers involved. We also entered into a settlement agreement and obtained USD20,000 as compensation for our client and all Unifrutti labelled boxes were destroyed (lemons were not destroyed to avoid food waste).

In addition, we are working in a broad filing with the Netherlands’ customs office in order to detect and identify other possible Unifrutti’s counterfeit products, and are replicating this model in the most conflictive jurisdictions.

This is the first tangible result of at least one year of work in the international recording of Unifrutti’s trademark (more than 300 trademarks worldwide), customs trademark records and coordination of legal actions in several countries.
