SPCG has led to the final and binding 100-fold reduction of the pecuniary penalty, before the Court of Appeal in Warsaw, which was imposed on a Polish leading telecommunications operator.

The penalty in the amount equivalent to EUR 30,000,000 (PLN123,246,000) was imposed by the decision of the President of UOKIK dated 4 November 2010. It concerned the alleged lack of operator’scooperation in the course of the investigation conducted by the President of UOKIK.

The Court of Competition and Consumer  Protection has changed the aforementioned decision in the judgment dated 20 March 2015 reducing the penalty 100-fold – to the equivalent of EUR 300,000.In the judgment dated 1 March 2017 the Court of Appeal in Warsaw found it appropriate for the Court of Competition and Consumer Protection to use the 100-fold reduction of pecuniary penalty.
