Sayenko Kharenko acted as a local legal counsel to ADM, Bunge, Cargill, COFCO, Louis Dreyfus Company and Glencore Agriculture on obtaining clearance of the Antimonopoly Committee of Ukraine (AMC) for the joint venture developing an independent and trusted digital platform to enable post-trade efficiency for the participants of the agri-industry.
The platform is expected to drive greater security, reliability, efficiency and transparency by digitizing manual, paper‐based processes tied to contracts, invoices, and payments, with a more modern, digitally based approach.
Following an in-depth market investigation initiated by the AMC, the parties presented well-structured and strong arguments to the AMC proving the absence of any anticompetitive effects. Having analysed the market studies and reactions of the market players, the AMC agreed with the findings and conclusions of the parties and approved the transaction in a timely manner.
Sayenko Kharenko antitrust & competition team advising on the project included senior associate Anastasia Bodnar and associate Snizhanna Savka under the supervision of partner Maksym Nazarenko.
