On September 29th, 2026, the publication of SECEX Circular No. 92/2026 initiated an anti-dumping investigation into Brazilian imports of 2-ethylhexyl acrylate (2-EHA) originating from China and the resulting injury to the domestic industry. The product under investigation is usually classified under subheading 2916.12.40 of the Mercosur Common Nomenclature (NCM).
The opening of the investigation was motivated by a petition submitted on January 30th, 2026, by BASF S.A., the sole Brazilian producer of the like product. After a preliminary analysis, the Foreign Trade Secretariat (SECEX), through the Department of Trade Remedies (DECOM), found sufficient evidence of dumping in exports from China to Brazil, injury to the domestic industry, and a causal link between them.
SECEX concluded, for initiation purposes, that market economy conditions do not prevail in the Chinese production sector for 2-EHA acrylate and adopted the United States of America as a third market-economy surrogate country for purposes of determining the normal value.

- Dumping margin determined for initiation purposes:
Absolute dumping margin: US$ 613.67/ton; and
Relative dumping margin: 43.42%.
The participation of interested parties, including the foreign producers or exporters from the investigated origin, Brazilian importers of the product under investigation, and the government of China, must be carried out through petitions in the Electronic Information System (SEI) of the Ministry of Development, Industry, Trade and Services (MDIC).
Questionnaires will be sent to known foreign producers or exporters and known importers, who will have 30 days from the date of notification to submit their responses. Given the large number of Chinese producers or exporters identified, questionnaires will be sent to those accounting for the largest reasonably investigable percentage of China’s export volume.
Parties not identified at the beginning of the proceeding that consider themselves interested may request accreditation, subject to the investigating authority’s review, within 20 days from the publication of the Circular.
During the investigation, provisional anti-dumping duties may be levied if sufficient evidence of dumping, injury, and a causal link between them is found and if it is understood that such measures are necessary to prevent injury to the domestic industry during the investigation.
The investigation must be completed within 10 months from the date of its initiation, extendable for up to 8 additional months. If the initial claims are confirmed, definitive anti-dumping measures may be applied for a period of up to 5 years.
