Law360 reported on a case in which Hurwitz Sagarin Slossberg & Knuff is representing the plaintiff, Northeast Emergency Medical Specialists, LLC (NEMS), a company that staffs the emergency departments at several Connecticut hospitals, against Harvard Pilgrim Health Care of Connecticut Inc. NEMS is claiming that the insurance company is violating the Connecticut Surprise Billing Law by charging patients more for out-of-network care in the form of a deductible or co-insurance.


Connecticut U.S. District Judge Sarala Nagala has asked the state supreme court for guidance on this legal battle. Due to a lack of controlling state appellate decisions, Judge Nagala said in a court docket, “The appropriate course of action is to certify several questions to the Connecticut Supreme Court because the answer may be determinative of issues in this litigation.”
