On December 18, 2024, the Labor Directorate (DT) issued Ordinary Letter No. 881, establishing a new requirement for companies: all processes for evaluating or assessing the performance of their employees must be explicitly included in the company’s Internal Rules on Order, Hygiene, and Safety.

Furthermore, this inclusion must be documented in Spanish. If drafted in another language, the relevant translation must be included in the Internal Rules at the time of being provided to employees.

Failure to comply with this new requirement may result in fines from the Labor Inspectorate for not including the performance evaluation protocol in the mentioned Rules. Consequently, companies are urged to review their Internal Rules on Order, Hygiene, and Safety and make the necessary updates to meet this new requirement.
