ZRp represented MPO to successfully quash the decision of the Industrial Court which awarded RM470,400.00 to the former General Manager of MPO who was terminated from service due to poor performance. The High Court agreed with our argument that the Industrial Court failed to apply the correct principles in the law of poor performance in relation to senior management employees who required less warning, supervision and guidance in the process of performance improvement.
The High Court's decision was handed down on 16.6.2016. On 14.3.2017, the Court of Appeal had upheld the decision of the High Court.
