In a CPD collaboration with Simmons & Simmons on Tuesday, 2nd September, Parkside Chambers' Benjamin Lam and Calving Ng delivered an introductory presentation on injunctions in aid of arbitration and foreign proceedings. About 40 people attended the insightful lunchtime session at Simmons & Simmons' offices, both in person and online.
After highlighting the key differences between applications made in court and in arbitration, Ben turned to Section 45 of the Arbitrations Ordinance and a number of his own cases illustrating the practical application of the provision.
Calvin's discussion focused on the added complexities of Hong Kong court applications in aid of foreign proceedings, and key points included the importance of experienced foreign lawyers. He examined the Hong Kong court's jurisdiction under s21M of the High Court Ordinance examined the test for interim relief, stressing the need for thorough evidence and careful legal strategy.
