Ilyashev & Partners’ Criminal Law team has succeeded in reducing the bail by UAH 183 million for the client in the Appeal Chamber of the High Anti-Corruption Court of Ukraine. The relevant court judgment was issued on 15 August 2024.
Ilyashev & Partners’ attorneys filed an appeal with the Appeal Chamber of the High Anti-Corruption Court of Ukraine against the ruling of the investigating judge of the High Anti-Corruption Court to reduce the bail for the client in connection with the setting of excessive bail without taking into account the current financial situation of the suspect and his family, thereby not meeting the purpose of the applied measure of restraint.
Ilyashev & Partners’ team provided evidence in court that bail was deliberately excessive for the client. In addition, the first-instance court provided an unfair valuation of the financial situation and available resources of the client’s family, which is confirmed by the findings of both Ukrainian and foreign experts.
Thanks to the well-defined strategy, the Appeal Chamber of the High Anti-Corruption Court partially accepted the position of Ilyashev & Partners’ attorneys that such bail was excessive and that the firm's client could not exercise his right to post bail as an alternative measure of restraint. As a result of the court judgment, the bail for the firm's client was reduced by UAH 183 million.
