Lawyers at Duncan Lewis have successfully prevented the Home Office from transferring a vulnerable asylum seeker away from her established support network.

 

We represented XY, who faced being dispersed to another part of the country despite independent medical evidence confirming that she suffered from serious mental health difficulties and would be at high risk of suicide if moved.

 

Despite repeated requests, the Home Office initially refused to confirm that the dispersal would be cancelled. After extensive representations, our team issued urgent judicial review proceedings and obtained an out-of-hours injunction preventing the transfer.

 

Following this, the Home Office granted our client refugee status and agreed to settle the claim, confirming she would not be dispersed from her current location.
