We advised Gloria in its defence against a claim for alleged abuse of dominant position, specifically, for modifying the status of a supplier in its distribution chain from dealer to wholesaler.
The Free Competition Commission of the INDECOPI declared the existence of anticompetitive conduct and imposed a fine equivalent to USD$ 40,000, which was appealed before the Competition Court. Based in our defence, the Competition Court of the INDECOPI revoked the first instance decision and declared that Gloria did not commit any infringement, eliminating the fine.
