MLL Legal has advised and assisted ARTEX MTF in connection with:
- the filing of an application for recognition as foreign trading venue for the admission of Swiss participants (in accordance with art. 41 of the Swiss Financial Markets Infrastructure Act); and
- the compliance requirements of the ARTEX MTF Rules for the first issuer, the Luxembourg securitization vehicle Art Share 002 S.A., to be admitted to trading on ARTEX MTF. Art Share 002 S.A. is the holder of the iconic artwork from Francis Bacon ‘Three Studies for Portrait of George Dyer, 1963’
The lawyers leading the project from the side of MLL Legal are Reto Luthiger (Partner, Regulatory, Fintech and DLT) and Diana Lafita (Senior Associate, Regulatory, Fintech and DLT). Other lawyers involved in the advice are Mark Montanari (Partner, Capital Markets), Alexander Vogel (Partner, Corporate) and Pranvera Rasaj (Junior Associate).
ARTEX MTF is a multilateral trading facility licensed and supervised in the Principality of Liechtenstein in conformity with the European Markets in Financial Instruments Directive (MiFID II), that has been exclusively created for admitting securitisation vehicles to trading which hold a prominent piece of artwork. This follows the trend of democratization of investment, in this case making the most sophisticated artwork which has historically been reserved to art collectors, easily accessible to different investor groups.
