The Poland team of DWF, led by Łukasz Gembiś, attorney and Local Partner heading the Contracts and Public Procurement Team, included Agnieszka Chylińska, Counsel, and Paulina Sawicka, Counsel. They provided advisory services to Baltic Towers sp. z o.o., a joint venture between the Agencja Rozwoju Przemysłu S.A. and the Spanish company GRI Renewable Industries, S.L. The advisory process led to the signing of a contract with ERBUD S.A. on 22 February 2024, for the design and construction of the production hall for the first offshore wind tower factory in Poland, with a value exceeding PLN 400 million gross.
The investment, located on Ostrów Island in Gdańsk, will establish a factory producing offshore wind towers for the largest planned wind turbines with a capacity of 15 MW and above. The modern production facility, designed and built according to Industry 4.0 standards, will have production capacities capable of producing over 150 towers annually. The new factory will meet the highest technical and quality standards set by key clients in the offshore wind energy market in Poland and worldwide. The investment is expected to create 500 highly specialised jobs.
DWF Poland's advisory services covered comprehensive support for Baltic Towers sp. z o.o. from the preparation and conduct of the tender procedure for selecting the general contractor, through the preparation of the contract for the design and construction of the factory, to assistance in negotiations with bidders and the process of concluding the contract with the general contractor, ERBUD S.A.
As project leader Łukasz Gembiś pointed out, "The construction of this type of investment within the supply chain of offshore wind energy is a strong impetus for the economic development of Poland and a key element of the growing offshore ecosystem. In the context of locating such investments in the supply chain and offshore investment schedules, it is essential to adequately secure contractual risks associated with the construction of the factory itself and to efficiently conduct the entire tender process, aiming to select an experienced and reliable partner responsible for project implementation. Risks of a project and legal nature, especially with the involvement of external financing institutions, required a special approach by a multidisciplinary team of advisors, well complemented within DWF Poland by the expertise led by Karol Lasocki, one of the leading legal advisory teams for renewable energy, particularly in the offshore sector.
