Thomson Geer acted in a large dispute for Caltex against a European based Nasdaq listed large software solutions company known as Fleetcor. The case involved an extremely complex claim by Caltex for more than $20 million in damages for breach of contract in respect of the failed provision by Fleetcor to Caltex of a bespoke replacement fuel/credit card payment and reporting software system. Fleetcor vigorously defended the claim and cross claimed for wrongful repudiation of contract by Caltex in the amount of $10 million. The case settled just before trial, in June 2019.
