Bergt Law is proud to have advised Floin AG on its successful authorisation as a crypto-asset service provider under Article 63 of Regulation (EU) 2023/1114 on markets in crypto-assets (MiCAR).
According to the official announcement by the Liechtenstein Financial Market Authority (FMA), Floin AG has held its CASP authorisation since 10 June 2026. The authorisation covers the following crypto-asset services:
• custody and administration of crypto-assets on behalf of clients
• exchange of crypto-assets for funds
• exchange of crypto-assets for other crypto-assets
• placing of crypto-assets
• transfer services for crypto-assets on behalf of clients
This marks a significant milestone for Floin, for Liechtenstein, and for the European crypto-asset market.
Floin has become the first licensed crypto-asset placing service provider in Liechtenstein and the first Article 63 MiCAR-licensed crypto-asset exchange provider in Liechtenstein. This is distinct from the simplified Article 60 route available to already licensed financial institutions.
The authorisation also provides a wider proof of concept for the European MiCAR framework. It shows that a startup and SME can obtain a highly demanding CASP licence where regulation is applied seriously, accurately, and proportionately to the actual business model, risks, governance, and operational structure of the applicant.
For Bergt Law, the project also demonstrates that specialised legal advisory can accompany the full lifecycle of a regulated financial institution, from regulatory strategy and structuring to documentation, supervisory dialogue, application work, and authorisation, with precision, pragmatism, and without the cost structure of large international advisory firms.
