Arzinger's attorneys successfully represented Stada, a pharmaceutical company specialising in the production of medicines, in a precedent-setting dispute with the tax authorities.


The tax authorities raised claims regarding the alleged inconsistency of the client's expenses for marketing services with its business activities. They argued that the purchase of these services from distributors was not related to the client's income. In their view, the transfer of ownership of the goods under the individual supply contracts took place upon shipment, which excluded any connection with the marketing services.

Following a lengthy litigation, the courts of first instance and appeal upheld the arguments of Arzinger's attorneys that the tax authority's claims were unfounded.
