Arzinger has defended the client's interests in a dispute against NPC Ukrenergo

Arzinger's dispute resolution team has successfully defended the client's interests in the Supreme Court in a dispute against NPC Ukrenergo.

The Supreme Court confirmed the legality of the decisions of the courts of previous instances, according to which NPC Ukrenergo was obliged to return more than UAH 2 million to the client. The dispute arose out of the fact that NPC Ukrenergo unlawfully recovered the amount of the guarantee, which ensured the client's performance under the contract, in its favour.

Arzinger's attorneys formed a legal position and managed to convince the judges of three instances that there were no legal grounds for the customer to recover (and not return) the guarantee amount, provided that the contractor fulfilled all obligations under the contract. Unfortunately, such unlawful actions by NPC Ukrenergo are becoming more and more frequent, and it is impossible to return the funds to the rightful owner without initiating a lawsuit.

The team working on the project included senior associate, attorney-at-law Ivan Zalizniak, and junior associate Bohdan Sukhodolskiy, led by founding partner Sergii Shkliar.
