Santiago de Chile, June 2022.- Abogabir Miranda, through its team led by partner Diego Abogabir, represented a car wash company in a lawsuit for 485,000 US dollars. Due to the termination of a contract for non-payment of rent during the state of constitutional exception of catastrophe due to the pandemic for Covid-19.
The car wash business had invested more than 400 million Chilean pesos in the remodeling of buildings and machinery in a place that it had leased before the pandemic started.
Abogabir Miranda's team was in charge of representing its client, from answering the claim, to filing another claim to honour the contract for the agreed period of 8 years. This is because there was no alleged breach and compensation for damages. In addition, they filed a precautionary measure prohibiting the holding of acts and contracts on the property while the trial lasted, which was granted by the court.
During the evidence presentation period, they reached an agreement that meant full compliance of the lease term and compensation for damages to their client.
The relevance of this case lies in the fact that the end of this conflict allowed its client to continue operating the business in the leased property. Otherwise, the car wash company would have had to return the leased property, mobilize its machines and assets, stop its operations; reinstall itself in another location and most likely the investment would have been lost.
