- Debtors. Debtors and debtors in possession are the focal point of any out-of-court workout, chapter 11 case, or chapter 7 case and are a major area of focus within Stewart Robbins' practice. The firm's attorneys represent debtors across a wide range of industries. In order to minimize conflicts and maximize the ability to zealously defend clients’ interests, the firm avoids representing financial institutions.
- Unsecured Creditors' Committees. Finding and preserving value for unsecured creditors has been a primary focal point for Stewart Robbins since its inception. Whether seeking value for a committee or a trustee, the firm's bankruptcy attorneys are well-versed in the complexities of valuation, security devices, avoidance actions. insolvency, tax attributes and business litigation.
- Trustees & Receivers. Stewart Robbins has represented trustees in hundreds of chapter 7 and 11 cases. In cases involving large-scale corporate fraud, the firm is called upon to investigate wrongdoing, and to prosecute claims to recover funds from perpetrators, and from recipients of fraudulent transfers.
- Asset Purchasers & Investors. Asset purchasers and outside investors often provide the fresh capital required to fund a plan of reorganization or to otherwise place valuable but overly levered capital assets back into commerce. Stewart Robbins' transactional attorneys have expertise across a broad spectrum of areas, including sales of companies or their assets, financing, real-estate purchase and sales, development and commercial leasing, and workout.
- Bankruptcy Financing Disputes. Litigation over debtor-in-possession and other bankruptcy financing often becomes a key issue in a bankruptcy case. This is particularly true with credit agreements negotiated pre-bankruptcy, which may contain covenants and provisions that can dictate the course of the case. Since bankruptcy financing can result in additional encumbrances of debtor-in-possession property or cash, this arena is of particular importance to unsecured creditors in large chapter 11 cases. The firm's bankruptcy attorneys have a proven track record of litigating effectively when credit agreements threaten the interests of its clients.
- Avoidance Actions & Claims Litigation. Stewart Robbins' attorneys address the spectrum of claims and avoidance litigation for debtors, committees, trustees, liquidation or post-confirmation trusts, and defendants, from large cases to smaller, individual matters. Attorneys litigate with confidence and expertise, achieving successful outcomes through discovery and trial when litigation proves the most viable option. As a result, the firm achieves greater efficiency and larger net recoveries than firms with less experience in this area of the law, particularly in cases containing numerous claims and avoidance matters.
- Asset Sales. It is a reality of bankruptcy practice that most cases are resolved through asset sales rather than through internal reorganization. However, proposed sales are often not as straightforward as they may appear. Competing interests can produce bidding procedures and marketing strategies engineered to advance the goal of a single party, at the expense of the estate as a whole. Stewart Robbins' clients benefit from firm attorneys' extensive experience navigating the tricks or traps of various sale strategies, and effective actions for defeating or approving them in litigation. Attorneys have experience navigating all aspects of the sales process, including Bid Procedures, Contested Bidding Procedures, Marketing of Assets, Sale Motions, Sales, and Transactional Formalities
- Bankruptcy Appeals. Bankruptcy appeals can be a procedurally complex area of the law. Unlike nonbankruptcy litigation, there is a great variety of orders in bankruptcy cases that may be subject to immediate appeal. Stewart Robbins' bankruptcy attorneys stand ready to handle appeals to the federal district courts, and federal circuit courts of appeal.
- Business Tort Litigation. An unfortunate truth in the bankruptcy world is that the only remaining value for unsecured creditors is often the debtor’s business tort claims and D&O insurance policy that are not encumbered by a lender’s security interest. The firm's attorneys have extensive knowledge in identifying and safeguarding these assets on behalf of clients, as well as navigating the complexities of related insurance coverage issues that invariably arise.
