PRK Partners provided sophisticated legal advice to Electricité de France (EDF) in connection with the New Nuclear Power Plant tender for construction of nuclear units at the Dukovany site and potentially at the Temelin site – recognized as the largest tender in the Czech Republic's history. The mandate notably included representing EDF in challenging the tender process after the Czech government selected Korea Hydro & Nuclear Power (KHNP) as the preferred bidder. Due to the specific nature of the tender, it did not fall under the traditional framework of public procurement as governed by the Public Procurement Act (or the relevant procurement directives). Therefore, we had to employ a highly innovative and creative approach – utilizing European Court of Justice case law – to establish that a reviewin such a tender was indeed permissible. PRK Partners filed a petition requesting judicial review of contracting authority's actions, culminating in a significant legal development in May 2024 when the Regional Court in Brno issued a preliminary injunction blocking the signing of contracts between Elektrárna Dukovany II and KHNP. This representation stands out as a landmark case in Czech administrative law nad public procurement. The court's preliminary injunction ruling noted that while it recognized the potential negative consequences of delaying the nuclear units' construction, the importance of upholding legal standards and ensuring effective judicial review outweighed these considerations.
