Ilyashev & Partners Law Firm defended the interests of national manufacturers and achieved the application of anti-dumping measures towards the imports of coated carbon steel coils from the People's Republic of China to Ukraine.

The Interdepartmental Commission on International Trade (ICIT) decided to apply final anti-dumping duties for five years to imports of coated carbon steel coils from China to Ukraine.

Anti-dumping duties will apply to imports of goods with the following description: flat carbon steel coils, laminated, galvanized or otherwise coated, classified under the Ukrainian Classification of Goods for Foreign Economic Activity (UCGFEA) codes 7210 70, 7210 90 and 7212 40. The rate of anti-dumping duty for manufacturers and exporters from China will range from 30.76% to 48.14%.   

The International Trade Practice team of Ilyashev & Partners Law Firm, headed by the Partner Olena Omelchenko, secured the initiation of the anti-dumping investigation by the Interdepartmental Commission on International Trade regarding imports to Ukraine of prepainted galvanized steel coils from the People's Republic of China back in 2020 by preparing a complaint on behalf of Ukrainian manufacturers.   

This anti-dumping investigation was one of the most extensive in history - more than 50 companies took interest in the investigation, the volume of commodity imports to Ukraine is also the largest. Up to a half of the market of prepainted steel coils in Ukraine was occupied by imports from China, which prevailed in the low-quality product segment. Due to dumping Ukrainian producers were not able to establish economically reasonable prices. “Ukraine has protected its market from unscrupulous imports of coated carbon steel coils from China. The Commission has introduced tariffs against Chinese manufacturers and exporters who are most aggressive in using the dumping procedures, Olena Omelchenko noted. – This is a very important decision for the national economy during full-scale Russian invasion of Ukraine. Domestic manufacturers have the ability and capacity to cover the market share occupied by Chinese imports. The competition of national manufacturers will grow in the market, the number of jobs will increase, which, in turn, will contribute to an increase in revenues to the state budget. In addition, Ukrainian consumers will be less dependent on imports.”

As it is known, Ukraine previously introduced a preliminary anti-dumping duty of 31.37% on imports to Ukraine of glass containers from Belarus. This was the first decision of the Interdepartmental Commission on International Trade on the application of restrictive measures towards the import of goods to Ukraine after 24 February 2022. The decision to introduce a customs duty was made further to the anti-dumping investigation based on the results of consideration of the complaint filed by the national manufacturers, also initiated by Ilyashev & Partners Law Firm.
