The International Dispute Resolution and Arbitration practice of Arzinger protected interests of the client - large Chinese manufacturer of welding equipment, in arbitration with Ukrainian buyer claiming return of the payment for undelivered equipment.

This ICAC at the UCCI case represents global trends in arbitration because it deals with cybersecurity issues. Third-party intervention in email system of Ukrainian buyer allowed swindlers to filter and amend emails and documents received by the claimant. As a result of a long-lasting cybersecurity breach Ukrainian buyer paid money to the swindler and not to the Chinese seller.

Arzinger developed defense strategy combining legal arguments and evidence collection in multiple jurisdictions (China, United Kingdom and Ukraine) to prove that no breach by the Chinese seller has taken place.

The project was managed by Volodymyr Nakonechnyi, Senior Associate and Attorney at Law, with the support of Associate and Attorney at Law Anastasiia Kotliarchuk. The case was implemented under the supervision of Timur Bondaryev, Founding & Managing Partner, Head of International Dispute Resolution and Arbitration practice.
