Lindsay Howard is of counsel in the Environmental Services group of Babst Calland. Since joining the firm, Mr. Howard has focused on issues related to complex site remediation, solid and hazardous waste, natural resource damages, and occupational safety and health for a broad array of clients, ranging from small entrepreneurs to Fortune 100 companies.
Mr. Howard devotes a significant portion of his practice to counseling clients on the complexities associated with buying, selling, owning and leasing properties that may be impacted by environmental issues. In addition to providing assistance throughout the environmental due diligence process, Mr. Howard has extensive experience with negotiating agreements that manage environmental risks and liabilities. When possible, state brownfield provisions (e.g., Pennsylvania’s Act 2) have been used as a tool to address these environmental legacies.
Since joining the firm, Mr. Howard has developed a national practice relating to issues arising in the federal and state Superfund arena. As part of this practice, Mr. Howard represents potentially responsible parties (PRPs) in all stages of the Superfund process, including responding to information requests, negotiating orders, decrees and agreements with the government and/or other PRPs, litigating response cost contribution claims if necessary, and coordinating the myriad of other issues that arise in the context of site remediation (e.g., remediation contracting). He also routinely counsels clients on issues related to natural resource damage claims under both federal and state programs.
Mr. Howard also provides counseling to major lending institutions with regard to environmental, safety and health issues that they may confront in their various roles as lenders, fiduciaries and property owners. For lenders, this work includes a wide range of environmental, safety and health issues, from developing internal lending policies and documentation to charting the best strategies for credit recovery and re-sale. Mr. Howard has also assisted fiduciaries in managing environmental risks associated with trust property, from identifying risks in the first instance to developing exit strategies at the end of the trust relationship.
Mr. Howard also provides day-to-day counseling to many clients on issues associated with facility and property risk management. In this context, Mr. Howard has gained substantial experience in addressing regulatory issues associated with underground storage tanks, asbestos abatement, indoor air quality (including mold and vapor intrusion) and off-site impacts.
Professional Memberships
Mr. Howard is a member of the Allegheny County, Pennsylvania and American Bar Associations. He has served as a Council Member of the Pennsylvania Bar Association’s Environmental, Mineral and Natural Resources Law Section and is a co-editor of the American Bar Association’s Section of Environment, Energy and Resources’ Environmental Transactions and Brownfield Committee Newsletter. Mr. Howard currently serves on the Board of Trustees for the Catholic Cemeteries Association.
