Ben is best known for advising clients on business-critical employment and industrial litigation, applying his expertise to client strategy. Motivated by high-risk and high-value industrial relations and employment challenges, Ben is sought out by clients in a range of industries including aviation, retail, transportation, stevedoring, media and energy. Ben advises leading organisations in relation to industrial disputes and industrial action, union and employee-related litigation, restructuring, redundancy and workplace change programs. Most recently, Ben has represented clients in restraint of trade litigation and high-profile and contentious bargaining disputes.

Career

Ben joined Seyfarth in 2013 as a founding partner in Australia. Having practised for more than 20 years assisting leading employers in handling complex employment and industrial matters, clients have come to rely on Ben’s broad experience, high degree of technical knowledge, formidable litigation skills, and practical approach to solving problems. Ben is particularly adept at helping clients successfully deal with contentious collective bargaining, individual employment disputes, and post-employment restraint of trade issues. He has:

• Successfully represented large employers in proceedings against unions relating to unlawful industrial action.

• Successfully defended a number of law firm partners from restraint of trade proceedings commenced by their former firm.

• Advised and represented numerous large employers in enterprise bargaining projects, including numerous media organisations, by providing strategic industrial relations advice in the face of protracted and contentious negotiations.

• Represented numerous employers in award review proceedings.

• Advised large employers on sensitive workplace conduct and behaviour investigations.

• Advised non-sensitive senior executive and senior leadership team issues, including negotiated departures.

• Advised on complex wage compliance projects.
