About

Provided by Brown Rudnick LLP

For more than three decades, Brown Rudnick has secured outsized results for many of the most demanding and sophisticated clients in the distress/insolvency arena, often in the face of impossible odds. Our approach heavily emphasizes case strategy, and we pride ourselves on the ability to look at insolvency issues differently from other professionals in the field.

Our lawyers regularly represent the interests of official and ad hoc committees (including mixed committees) comprised of public debt holders, trade creditors, and/or labor interests, and we are particularly adept at balancing and harmonizing varying perspectives towards consensus. We are regularly called upon to assist stakeholders with value entitlements that are the most at risk, such as subordinated creditors and stockholders, and have experience contesting unfavorable contentions of business value. In addition, we have considerable experience representing secured term lenders, tort claimants, debtors, asset purchasers, examiners, mediators, and proposed plan sponsors in the successful pursuit of their particular case objectives.

Our practice encompasses all procedural mechanisms for resolving indebtedness, including Chapter 11 reorganizations, out-of-court workouts, catastrophic corporate loss, mass tort, liquidations, fixed charge and administrative receiverships, restructured credits and securitizations, security enforcements, corporate investigations, and all other forms of insolvency-related litigations.
