Phyllis H. Marcus heads Hunton Andrews Kurth’s advertising counseling practice. With 17 years of prior leadership experience at the Federal Trade Commission, Ms. Marcus brings a unique vantage point to her retail, consumer products and technology clients. Her practice focuses on all aspects of advertising, from pre-acquisition diligence, initial product development, claim creation and substantiation establishment, to dissemination in traditional channels, digital, streaming, and social media, and the metaverse. Ms. Marcus also is the foremost expert on children’s privacy in the United States, having literally “written the book” (or at least, the rules) on the subject. For many years she led the FTC’s children’s online privacy program, bringing COPPA penalty actions and spearheading the 2013 overhaul of the COPPA Rule. This experience provides her with a keen understanding of the Ad Tech and digital environments as they apply to children.
Ms. Marcus was recognized as a Media and Advertisement Law Trailblazer by The National Law Journal and is a sought-after speaker at advertising and children’s privacy conferences. She been interviewed countless times by national media outlets, including by Bloomberg Law, Law360, and AdAge. Ms. Marcus also is a regular contributor to Hunton’s Retail Blog and Retail Year in Review.
