Experience

Will works with large multinational companies, as well as small and midsize businesses, on environmental compliance and permitting matters. He defends clients involved in environmental enforcement actions, government investigations, and third-party lawsuits related to compliance with environmental laws. He also routinely works with private equity firms, lenders, and other parties on M&A and real estate deals and assists those clients in structuring transactions to minimize environmental liabilities and risks.

Will routinely advises clients involved in traditional and alternative energy production; petroleum refining; biogas production; solid and hazardous waste collection, processing, and recycling; public and private water and wastewater utility services; medical device manufacturing; and automobile and auto parts manufacturing, among others.

Will's environmental compliance and permitting experience touches on all major environmental laws, with particular emphasis on the Clean Air Act, Clean Water Act, and Resource Conservation and Recovery Act.

A substantial part of Will's practice involves litigation defending third-party appeals of environmental permits and challenging environmental permit conditions on behalf of the industry. He has also defended clients in state and federal court actions brought under the federal Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) and other lawyers addressing liability for environmental contamination.

Will has extensive experience working with parties conducting environmental remediation projects dealing with soil, surface water, and groundwater contamination under both state and federal regulatory programs (RCRA Corrective Action, CERCLA, etc.).

In addition, Will frequently advises buyers, sellers, and lenders on environmental liabilities in real estate and M&A transactions. He helps clients structure these transactions to reduce the risk of liability from known and unknown environmental concerns.
