David is a trial and appellate lawyer in antitrust, patent, trade secret, class action, constitutional, and other cases. High-profile matters include US Supreme Court arguments, a gubernatorial election contest trial, and Costco’s challenges to anticompetitive liquor laws. He is national counsel for a defendant in the National Prescription Opiate MDL and related federal and state court cases and played the same role in the Pharmaceutical AWP MDL. In the last few years he has tried major patent, licensing, and antitrust cases. David is a member of the Advisory Committee on the Federal Civil Rules, a fellow of the American College of Trial Lawyers, and a member of the American Law Institute.
