Toby Kempster specialises in personal injury and employment law, the common denominator being the workplace.
Toby’s personal injury work is principally concerned with employers’ liability and includes more complex claims for example those arising from occupational disease (in particular cases involving asbestos exposure) and stress. He has considerable experience in FAA claims and high value claims arising from the loss of limbs, and head & spinal injuries. In the last year he has been involved in successful claims where damages totalling approximately £15m have been recovered.
His employment practice covers both contractual and statutory claims, the former including injunctive proceedings; he has recently succeeded at trial in resisting attempts to prevent an outgoing sales manager from working for a rival company. Dealing with complex quantum issues in his personal injury practice also assists for example in assessing the value of discrimination claims (particularly those involving disability) where long term unemployment is anticipated.
