The firm’s team has acted in the most importante recent insolvency cases in Brazil, counselling debtors, creditors and investors in all aspects of debt restructuring and insolvency, including strategy, negotiation, participation in shareholders’ and creditors’ meetings, litigation and accomplishment. In 2019 the team represented the debtor in very important in-court restructurings, such as OAS Group, Heber Group, Renuka Group, BR Pharma Group, Bom Jesus Group, Globoaves, Abengoa Bioenergia, Avianca. Out-of-court, the team assisted the debtor in the restructuring of Queiroz Galvão Energia, Usina Santa Terezinha and Libra Group.
Thomaz Bastos, Waisberg, Kurzweil Advogados advises its clients in complex and strategic dispute resolution, which includes commercial, corporate, civil and antitrust litigation and arbitration as well as preventive measures, out-of-court questions and preparation for litigation, arbitration and settlement. The main cases are confidential.
In many cases, the team has acted together with foreign law firms in order to deal with cross-border aspects of restructuring and insolvency, such as the recognition of the restructuring plan of OAS and the recognition of the judicial reorganisation of an English trading company of Bom Jesus Group by the English courts. Thomaz Bastos, Waisberg, Kurzweil Advogados has also acted together with foreign law firms advising a Brazilian mill in an international arbitration before the Refined Sugar Association in London.
