Firm Overview:
For six decades, Daniel Law has been helping to protect and carefully manage the ideas, assets and innovations that give dynamic businesses their competitive edge.

Daniel understands the opportunities and risks that clients face, and how to prepare for them. With a deep knowledge of Brazil’s complex legal and regulatory environment, the firm combines leading-edge technical and litigation expertise with real-world business experience to deliver tailor-made, proactive legal services and advice that fit its clients’ unique goals, business considerations and resources.

Most of Daniel’s IP attorneys and technology specialists also have advanced degrees or hands-on experience in engineering, physics, computer science, biology, materials science and chemistry. Their expertise enables the firm to provide strategic guidance on the development, use and enforcement of its clients’ IP portfolios, advise them on critical risks, recommend strategies for asserting their IP rights, and even provide analysis related to the IP assets of the key competitors.

Daniel is proud to be the largest woman-owned, woman-led law firm in Latin America and to be certified as a Women-Owned Business by WEConnect International, guaranteeing that the firm meets the universal standards for Women’s Business Enterprises (WBEs). Because Daniel understands and appreciates that the firm’s success is due to its people, Daniel has long embraced diversity in the workplace.

Main Areas of Practice:

Patent Litigation:
At Daniel, the deep bench of trial lawyers have extensive experience in all aspects of patent litigation, including highly complex cases involving cross-border matters, cutting-edge technologies and multipleparty disputes.

Patent Prosecution:
The team of patent prosecution experts offers a rare combination of legal expertise and technical acumen, enabling the firm to have a deep understanding of the details of both the law and technology behind even the most complex of client inventions.

Trademark Prosecution:
Daniel is currently responsible for more than 25,000 trademark applications and registrations (Brazil and foreign). The firm also regularly manages large trademark portfolios, including those totalling more than 10,000 registrations/applications covering more than 200 countries. The firm recognises that it isn’t enough to simply register clients’ trademark - it is also vitally important to ensure that the underlying trademark registration strategy is sound.

Trademark Litigation & Enforcement:
Daniel offers a complete range of services to protect, preserve and exploit trademarks and trade dress, such as unfair competition claims, domain name disputes, cybersquatting and breach of contract. The firm also has a track record of success managing anti- counterfeiting programs, including customs and border seizures, and ex parte evidential search and seizure orders to track down evidence of possible infringement, for some of the world’s most recognised brands.

Judicial Appeals:
At Daniel, many of the attorneys have significant experience in both prosecution and litigation — by design. This unique perspective gives them the ability to make the kind of split-decisions regarding issues that may be pivotal to a case at any stage of its life cycle. It also helps ensure that the litigation and BPTO teams work together so that their strategies are cohesive and align with the client’s position in each case.

Licensing & Commercial Transactions:
Daniel’s licensing and business transactions practice group is a cross-functional, experienced legal team dedicated to helping clients to develop, protect and enforce IP assets, expand market share, and commercialise their IP and technology assets. The firm serves clients in a broad range of industries, including biotechnology, software, electronics, electrical and computer technology, telecommunications, pharmaceuticals, financial services and consumer products.

Industrial Design:
Daniel’s industrial design practice focuses on securing enforceable and sustainable design rights that further its clients’ business goals. Recognising the often-complex interplay between industrial design law and other forms of intellectual property, the industrial design attorneys collaborate closely with the patent and trademark practice groups to provide practical advice on design protection, whether through an industrial design registration, trademark registration or copyright.

IT, Privacy & Data Protection:
Daniel’s team is uniquely qualified to advise businesses on planning, drafting, implementing, reviewing and updating best practices and compliance programs of data protection and information management. Their interdisciplinary approach considers the applicable laws, regulations and rules to assist clients with security measures on data prevention loss, compliance with data protection and privacy principles and adoption of operational and administrative procedures to respond to data subject rights requests in a timely manner. At the same time, Daniel can help to maintain the highest standards of corporate governance on data protection, increase competitiveness and achieve business goals while steering the client through the myriad of local differences in data protection in Brazil and Latin America.
