Public Policy:
BFA actively engages in the public policy agenda affecting the ICT industry in the Brazilian Congress as well as before the Executive Branch; including the crafting of engagement strategy and position papers. Key focus on Internet regulation, privacy, cyber security, IoT, industrial policy, audiovisual policy and similar matters. The firm also works closely with sector specific regulators such as Anatel and Ancine, as well as the relevant Ministries, in public consultations and debates around the update of the regulatory framework having an active engagement in digitisation strategies.

ICT Regulation:
BFA has legal, institutional and technical expertise in the telecommunications and audiovisual sectors; including telecommunications services and networks, such as mobile services, broadband services, payTV, streaming technologies and so on. The firm works on international benchmark and innovative proposals for regulation that is welcoming to innovation and economic growth, structuring innovative and disruptive business models and their compliance to applicable frameworks. BFA closely monitors governmental decision-making processes. Its regulatory work also includes legal support on administrative proceedings before regulators. BFA further supports companies entering the telecommunications market, by structuring the business in a strategic manner, applying for licenses and negotiating the required contractual relationships as well as IoT and industry 4.0 business models and products.

Digital & Privacy Law:
BFA has extensive experience in advising clients in the digital environment. The firm provides support on content agreements, data protection policies and compliance, as well as in the protection of clients’ intellectual property rights and negotiating contracts for image rights, software, content licensing and trademark registration. BFA has had a prominent participation in the construction of Brazil’s general data protection legislation and currently assists local companies, both digital and offline to become adequate.

BFA provides clients with corporate assistance in incorporating a legal entity in Brazil as well as in taking care of day to day corporate documents and compliance. The firm also is able to draft and negotiate operational and commercial agreements such as outsourcing, distribution, services and consulting agreement, software licenses, purchase and sale, supply and the like.
