Litigation Practice:

The principal objective of the firm is to have a dispute settled most expeditiously and be cost effective to the client. If court process is unavoidable, the firm has vast experience in dealing with most complex and weighty litigation matters.
■ Advising on and enforcing recoveries on behalf of banks and other commercial institutions arising from securities and guarantees
■ Involved in complex election disputes. Part of the team that successfully represented Kenya’s electoral body in the disputed 2013 presidential elections and has fully successful defended matters and contested right up to the Supreme Court
■ Acting for and advising the Spedag Interfreight Group of companies on the successful recovery of an excess of US$2.5million under a breach of contract claim on account of monies owed for shipping and logistics services provided against two international companies which were placed in administration in their respective jurisdictions under insolvency proceedings
■ Advised Kenya Ports Authority on the claim by The Dockworkers Union on account of pension contribution for a sum in excess of Kshs. 6.9billion. The litigation at the High Court was successfully defended with the claim being dismissed though the matter is still pending on a review application
■ Representing a leading logistics service provider in a large claim arising out of an employment dispute before the Supreme Court
■ Advising and successfully representing the Kenya Ports Authority in the litigation on a claim arising out of damage to the ‘TEAMS’ undersea cable at Mombasa during dredging works being undertaken by the ‘MV Athena’– Van Oord Dredging and Marine Contractors BV – for over US$ 66million
■ Representing Mombasa Cement Limited for defending its proprietary interests in land. Value in excess of US$ 6Million
■ Representing Synergy Gases on a compensation claim against the Government of Kenya for road compensation. Value in excess of US$ 3Million
■ Representing Royal Boskalis Westminster N.V. against a claim for damages during dredging operations at the port of Mombasa

Alternative Dispute Resolution:

Patel & Patel has a well-established and highly regarded alternative dispute resolution department which advises on a full range of contentious commercial disputes including shipping, marine, construction and trade disputes as well as matters arising out of contractual claims, tax demands, fraud, insolvency, environmental and real estate disputes. In addition to this, the firm has undertaken diverse litigation involving administrative, constitutional and election laws.
■ Advising the Kenya Ports Authority successfully in the arbitration/ adjudication with Van Oord arising out of sum of an amount withheld by it for cables damage incident. The claim lodged in adjudication under the agreement with the Authority at the London Court of International Arbitration was determined by a Dispute Adjudication Board of three eminent London Q.C’s. Value in excess of US$ 8million
■ Represented Vipingo Ridge Ltd. on claims by a residence owner on issues of service charge element
■ Represented the Kenya Ports Authority on claims for salvage remuneration involving ships that ran into difficulty in Kenyan territorial waters with cargo valued at in excess of US$ 42million which cumulatively resulted in successful recoveries for the contractors following reference of the matters to arbitration in London
